Welcome to ColegioCheck.

These Terms of Service (“Terms”) govern your access to and use of the ColegioCheck website, platform, content and services (collectively, the “Services”).

By accessing or using ColegioCheck, you agree to these Terms. If you do not agree with these Terms, please do not use our Services.

1. About ColegioCheck

ColegioCheck is an online platform designed to help parents, students and families discover, compare and learn more about schools.

Our Services may include:

School profiles and information;
User reviews and ratings;
Guides and editorial content;
Interviews and other educational content;
Tools to search for and compare schools; and
Features and services available to registered users and schools.

ColegioCheck aims to make information about schools easier to access and understand. However, we do not guarantee that all information available on the platform is complete, accurate or up to date.

2. Eligibility and Use of the Services

You agree to use ColegioCheck only for lawful purposes and in accordance with these Terms.

You must not use the Services in a way that:

Violates applicable laws or regulations;
Harms or attempts to harm others;
Interferes with the proper functioning of the platform; or
Infringes the rights of ColegioCheck, other users, schools or third parties.

If you create an account, you are responsible for ensuring that the information you provide is accurate and up to date.

3. User Accounts

Some features of ColegioCheck may require you to create an account.

When creating and using an account, you agree to:

Provide accurate and truthful information;
Keep your login details secure;
Not impersonate another person or organisation;
Not create accounts for fraudulent, abusive or misleading purposes; and
Notify us if you believe your account has been accessed without your permission.

You are responsible for activities carried out through your account.

ColegioCheck reserves the right to suspend or terminate accounts that violate these Terms or are used in a fraudulent, abusive or unlawful manner.

4. Reviews and User-Generated Content

ColegioCheck may allow users to submit reviews, ratings, comments or other content (“User Content”).

By submitting User Content, you confirm that:

Your content reflects your genuine experience or honest opinion;
Your review is truthful to the best of your knowledge;
You are not submitting content that is knowingly false or misleading;
You are not submitting content in exchange for undisclosed payment, benefits or incentives;
You have the right to publish the content; and
Your content complies with these Terms and applicable laws.

You are solely responsible for the content you submit.

Reviews must not contain:

False, misleading or deliberately deceptive information;
Defamatory statements;
Threatening, abusive or offensive content;
Hate speech or discriminatory content;
Personal attacks or harassment;
Illegal or unlawful content;
Confidential information;
Personal information about other individuals without their permission;
Personal information that could identify a child or minor;
Names, contact details or other sensitive information relating to students or minors;
Advertising, spam or unrelated promotional material; or
Content that infringes another person’s intellectual property rights.

Reviews should focus on relevant experiences and opinions relating to the school.

The publication of a review does not mean that ColegioCheck endorses or verifies the statements made in that review.

5. Review Moderation

ColegioCheck may, but is not obligated to, review, moderate, edit, reject or remove User Content.

We reserve the right to remove or restrict content that we reasonably believe:

Violates these Terms;
Violates applicable laws;
Contains inappropriate or harmful information;
Contains personal information about minors;
Is false, misleading or fraudulent;
Is intended to manipulate ratings or reviews; or
May cause harm to users, schools or third parties.

We may investigate suspicious reviews or activity intended to manipulate the ratings or reputation of a school.

ColegioCheck does not guarantee that all reviews published on the platform are accurate or complete.

6. Reporting Content

If you believe that content published on ColegioCheck violates these Terms, your rights or applicable law, you may contact us to report the content.

We may review reported content and take appropriate action.

This may include:

Removing content;
Restricting access to content;
Editing content where appropriate;
Contacting the author of the content; or
Taking other action considered necessary to protect users or the platform.

The decision to remove or retain content will be made by ColegioCheck based on the available information and applicable law.

7. School Information

ColegioCheck may create and display profiles for schools on the platform.

Information displayed on a school profile may be obtained from publicly available sources, information provided by schools, users or other relevant sources.

School information may include:

School name and location;
Educational programmes;
Curriculum;
Age ranges;
Languages;
Facilities and services;
Contact information;
Fees;
Admissions information; and
Other relevant information.

While we aim to provide useful and accurate information, information about schools may change over time.

We recommend that users contact a school directly to confirm important information before making decisions relating to school selection, admissions or enrolment.

ColegioCheck is not responsible for decisions made based solely on information available on the platform.

8. School Profiles and Subscriptions

A school profile may exist on ColegioCheck even if the school has not subscribed to or actively participated in the platform.

Schools do not automatically have the right to manage, edit or control their profile.

An active ColegioCheck subscription is required for a school to claim and manage its profile and access subscription features.

Claiming a School Profile

A school with an active subscription may request to claim its school profile.

The person submitting the request must confirm that they are authorised to act on behalf of the relevant school.

ColegioCheck may request additional information or documentation to verify the identity and authority of the person claiming the profile.

Once a school has been successfully verified and has an active subscription, authorised representatives may gain access to the school’s profile management features.

These features may include the ability to:

Update and manage school information;
Edit relevant profile details;
Add or update descriptions;
Add or update images and other profile content;
Update contact information;
Provide information about educational programmes, curriculum, facilities and services; and
Respond publicly to reviews submitted about the school.

The availability of specific features may change over time.

Schools are responsible for ensuring that all information they provide or update is accurate, complete and up to date.

ColegioCheck reserves the right to review, reject, edit or remove information that is inaccurate, misleading, inappropriate or in violation of these Terms or applicable law.

Ownership and Independence

Claiming or managing a school profile does not give the school ownership of the ColegioCheck platform, the school profile, user reviews or ratings.

ColegioCheck remains an independent platform.

Schools may not remove, edit or modify independent user reviews or ratings.

ColegioCheck may continue to display reviews, ratings and other relevant information about a school in accordance with these Terms and applicable law.

Schools and their representatives must not:

Provide false or misleading information;
Manipulate ratings or reviews;
Create fake accounts or submit fake reviews;
Offer incentives in exchange for misleading or dishonest reviews;
Pressure, threaten or harass users to remove or change legitimate reviews;
Attempt to identify anonymous reviewers; or
Interfere with the independence or integrity of the ColegioCheck platform.

9. School Subscriptions and Payments

ColegioCheck may offer paid subscriptions to schools.

An active subscription is required for a school to claim and manage its profile and access subscription features.

Subscription Features

An active school subscription may provide access to features including:

Claiming and managing the school’s profile;
Updating school information and profile content;
Adding or updating descriptions and images;
Managing relevant school details;
Responding publicly to reviews; and
Other features made available by ColegioCheck from time to time.

The specific features included in a subscription may change over time.

Annual Subscription

School subscriptions are offered on an annual basis.

The applicable subscription fee is charged once per year.

By purchasing a subscription, the school agrees to pay the applicable annual subscription fee.

Unless otherwise clearly stated at the time of purchase, the subscription will automatically renew at the end of each annual subscription period.

The applicable subscription fee will be charged once per year for each renewed subscription period.

Cancellation

A school may cancel its subscription before the applicable renewal date.

Cancellation will prevent the subscription from automatically renewing for the following annual subscription period.

Unless otherwise required by applicable law, cancellation does not result in a refund for the remaining part of the current subscription period.

The school will continue to have access to subscription features until the end of the paid annual subscription period.

After a Subscription Ends

After a subscription expires or is cancelled, the school will no longer have access to subscription features, including the ability to manage or update its school profile and respond to reviews.

The school profile may remain publicly visible on ColegioCheck.

Information previously added or updated by the school while its subscription was active may remain visible on the school’s profile after the subscription has ended.

Any responses to reviews previously published by the school may also remain publicly visible after the subscription has ended.

The expiration or cancellation of a subscription does not automatically result in the removal of information, content or responses previously published by the school.

ColegioCheck reserves the right to remove or modify content where required by applicable law, these Terms or for the proper operation and integrity of the platform.

Renewal

The school is responsible for cancelling its subscription before the renewal date if it does not wish to continue for another annual subscription period.

Where required by applicable law, ColegioCheck may provide notice or a reminder before an automatic renewal takes place.

Changes to Pricing

ColegioCheck may change subscription pricing from time to time.

Any changes to subscription pricing will apply to a future subscription period and will not affect a subscription period that has already been paid for.

Where appropriate, ColegioCheck will provide reasonable notice before changes to pricing take effect.

Failed Payments

If an annual subscription payment cannot be successfully processed, ColegioCheck may suspend access to subscription features until payment has been successfully completed.

If payment remains outstanding, ColegioCheck may cancel or terminate the subscription.

Termination by ColegioCheck

ColegioCheck reserves the right to suspend or terminate a subscription if a school or its representatives:

Violate these Terms;
Provide false or misleading information;
Attempt to manipulate reviews or ratings;
Misuse their access to the platform; or
Engage in unlawful, fraudulent or abusive behaviour.

Where reasonably possible, ColegioCheck may provide notice before taking such action. However, immediate action may be taken where necessary to protect users, the integrity of the platform or other parties.

10. Intellectual Property

The ColegioCheck website, branding, design, software, content, graphics, logos and other materials are owned by or licensed to ColegioCheck and are protected by applicable intellectual property laws.

You may use the Services for personal and lawful purposes.

You may not, without prior written permission:

Copy or reproduce substantial parts of the platform;
Use ColegioCheck content for commercial purposes;
Scrape or systematically collect data from the platform;
Reverse engineer or interfere with the Services;
Use ColegioCheck trademarks or branding without permission; or
Reproduce, distribute or exploit our content in a way that infringes our rights.

User Content

User Content remains the responsibility of the person or organisation that submitted it.

By submitting User Content to ColegioCheck, you grant ColegioCheck a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, adapt and use that content for the purpose of operating, improving and promoting the Services.

11. Third-Party Content and Links

ColegioCheck may contain links to third-party websites or services.

These third-party websites are not controlled by ColegioCheck.

ColegioCheck is not responsible for:

The content of third-party websites;
The availability of third-party services;
The privacy practices of third parties; or
Products or services offered by third parties.

Your use of third-party websites is subject to their own terms and policies.

12. No Educational or Admissions Guarantee

ColegioCheck provides information to help users research and compare schools.

We do not guarantee:

Admission to any school;
Acceptance into a particular programme;
The availability of places;
The quality of education provided by a school;
The accuracy of all school information;
The accuracy or reliability of reviews; or
Any particular outcome resulting from the use of our Services.

Parents, students and families are responsible for making their own decisions and carrying out any additional research they consider necessary.

13. Disclaimer

The Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, ColegioCheck does not guarantee:

That all information on the platform is accurate, complete or up to date;
That all reviews are accurate or reliable;
That the Services will always be available without interruption;
That the platform will be free from errors; or
That a particular school will be suitable for a particular user or family.

ColegioCheck may update, modify, suspend or discontinue parts of the Services from time to time.

14. Limitation of Liability

To the fullest extent permitted by applicable law, ColegioCheck shall not be liable for any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the Services.

This includes losses arising from:

Reliance on reviews or school information;
Decisions relating to school selection or admissions;
User-generated content;
Errors or inaccuracies in information provided by third parties; or
Temporary unavailability of the Services.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted by applicable law.

15. Privacy

Your use of ColegioCheck is also subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use and protect personal data.

By using ColegioCheck, you acknowledge that your personal data may be processed in accordance with our Privacy Policy and applicable data protection laws.

16. Prohibited Use

You agree not to use ColegioCheck to:

Violate any applicable law or regulation;
Harm, harass or threaten others;
Submit false or misleading information;
Manipulate ratings or reviews;
Create fake accounts;
Upload malicious software or harmful code;
Attempt to gain unauthorised access to our systems;
Collect personal data without permission;
Exploit or expose personal information about children or minors; or
Interfere with the proper functioning, security or integrity of the platform.

We may suspend or terminate access to users who violate these Terms.

17. Suspension and Termination

You may stop using ColegioCheck at any time.

We may suspend or terminate your access to the Services if we reasonably believe that you have:

Violated these Terms;
Violated applicable law;
Misused the Services; or
Infringed the rights of other users or third parties.

Where appropriate, we may provide notice before taking action.

However, we may take immediate action where necessary to protect users, minors, the platform or other parties.

18. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the “Last updated” date at the top of this page.

Your continued use of ColegioCheck after updated Terms become effective means that you accept the revised Terms.

If you do not agree with the updated Terms, you should stop using the Services.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction in which ColegioCheck operates, unless otherwise required by mandatory applicable consumer protection or other applicable laws.

Nothing in these Terms affects any rights you may have under mandatory applicable law.

20. Who Operates ColegioCheck

ColegioCheck is operated by Eva Reijnierse, an individual based in Spain, NIE Y8893379Y.
